Terms and Conditions

§1. GENERAL PROVISIONS

Online shop available on the internet website www.karolinakusy.com is owned by Pracownia Krawiecka Karolina Kusy, Sarzyna 691, 37-310 Nowa Sarzyna, e-mail kontakt@karolinakisy.com , NIP: 8161709305 , REGON 384390443, phone number: 790767306
Definitions:
- Terms and conditions – the Terms and conditions of this online shop;
- Online Shop – Seller’s online shop available on the internet website www.karolinakusy.com;
- Seller – Pracownia Krawiecka Karolina Kusy, e-mail kontakt@karolinakisy.com NIP (Tax Identification Number) 8161709305, REGON (Statistical Number in National Official Business Register) .
- Buyer – a natural person, a natural person conducting a business activity, a legal person or an organizational unit without legal personality, which uses the services provided electronically by the Seller;
- Electronic Order Form – form which is available in Online Shop and enables placing an Order;
- Order – Buyer’s declaration of will, which constitutes an offer to conclude a Product sales contract with the Seller;
- Product – a movable item available in the Online Shop, which is the subject of the sales contract between the Buyer and the Seller;
- Proof of Purchase – receipt or VAT invoice;
- Sales Contract – a contract for the sale of a Product within the meaning of the provisions of the Civil Code (Journal of Laws 1964 No. 16, item 93, as amended), concluded via the Online Shop in Polish;
- Newsletter – Electronic Service, electronic distribution service which allows all Service Recipients to automatically receive periodic content of subsequent editions of the newsletter containing information about products, news and promotions in the Online Shop provided by the Service Provider via e-mail;
- Appendix 1 – document attached to the this Terms and Conditions, which enables withdrawal from the contract as stated in §8
By filling the Registration form, a Buyer acknowledges that he/she knows and accepts the Terms and Conditions.
Notifications, advertisements of the Seller, price lists and other information on Products which are provided on the pages of the Internet Shop, in particular descriptions and technical parameters and prices constitute an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code and on April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
Provisions of this Terms and Conditions are not intended to exclude or limit any rights of the Customer who is also a Consumer within the meaning of the Act of 23 April 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended), to which he/she is entitled to under the binding provisions of law. In the event of non-compliance of the provisions of this Terms and Conditions with the above provisions, the binding provisions of law shall take precedence.

§2. CONDITIONS FOR PLACING AN ORDER

Buyer undertakes to use the Internet Shop in a manner which is compliant with binding provisions of law, principles of social coexistence and good manners, having in mind respect for personal rights and intellectual property rights of third parties.
The Internet Shop sells all over the World.
Orders can be placed 7 days a week, 24 hours a day. Orders are fulfilled in business days from Monday to Friday, from 9:00 a.m. to 3:00 p.m. (with exclusion of public holidays).
Buyer will receive confirmation of placing an order and confirmation of acceptance to fulfil the Order from the Seller in a form of an e-mail.
The contract of sales is treated as concluded once Buyer receives an e-mail with confirmation.
Average time of fulfillment of the Order (from placing an order until shipping to a Buyer) is 20 business days. Orders placed after 12/15/this year will be shipped after Christmas. Time of express realisation is up to 7 business days.
Estimated time of courier delivery is 1-2 business days from the shipping day for domestic courier deliveries. Time for international courier deliveries depends on the destination country.

§3. PAYMENTS

Prices provided in the Online Shop are in Polish Zlotys and are gross prices. Prices do not include the costs of delivery, which are provided during placing an Order.
Proof of purchase is attached to every Order.
A Buyer who is not a natural person states that he/she is a VAT payer and authorises the Seller to issue a Proof of purchase without signature of a recipient.
In case of Orders which are to be delivered outside Poland advanced payment is only acceptable form.
Products are shipped within 20 business days, from the moment of receiving the payment of 100% of the value of the order on the Seller’s bank account (excluding cash on delivery).
The Seller reserves the right to change the prices of the Products. The Orders placed before the above changes, are fulfilled on the terms and conditions binding in the moment of placing an order.
If a Buyer does not make the payment within 3 days from receiving Order confirmation, the Seller reserves the right to cancel the Order, informing the Buyer by e-mail or telephone.

§4. DELIVERY

Products ordered via the Online shop are delivered all over the World.
Deliveries in Poland are made by DPD courier company.
Orders to non-EU countries are delivered by FEDEX courier company.
A Buyer is informed about the costs of delivery during an Order placement.
The delivery costs are borne by the Buyer.
The Seller undertakes to provide the Buyer with Products free from defects.
The Buyer undertakes to collect the shipped Product.

§5. WITHDRAWAL FROM THE CONTRACT

A Buyer who is a consumer within the meaning of Art. 221 of the Civil Code (Journal of Laws No. 16 item 93, as amended), has the right to withdraw from a distance contract, without giving any reason, within 14 days from the date of receipt of the Product.
For the effective withdrawal from the contract referred to in point 1 of this paragraph, it is sufficient for the Buyer to submit a written statement by e-mail or post within the statutory 14-day period from the moment of receiving the parcel. The template of the declaration is included in Appendix No. 1.
In the event of withdrawal from the contract, the Customer is obliged to return the Product to the Seller immediately, but not later than within 14 days from the date on which the Customer informed the Seller about the withdrawal from the contract to the following address: Pracownia Krawiecka Karolina Kusy, Sarzyna 691, 37-310 Nowa Sarzyna.
The Buyer, withdrawing from the contract, is obliged to return the Product in the unaltered state together with the Proof of Purchase or its copy within 14 days from the date of withdrawal.
A consumer can make a return or exchange provided that the following cumulative conditions are fulfilled:
- A consumer has a proof of purchase of the Product
- The Product doesn’t show signs of use, it’s not damaged or dirty
- On condition that the Product was in original packaging, it shall be returned in the same and undamaged packaging,
- The Product has all original markings attached (labels, price tags). These markings must be original (i.e., provided by the Seller) and cannot show signs of removal and reattaching.
- The Product is complete, i.e., it contains all originally added, extra elements, e.g., suspenders, belts.

The Seller refunds the payment using the same method of payment as used by the Buyer, unless the Buyer has expressly agreed to a different method of return, which does not involve any costs for him.
In the event of withdrawal from the contract, the Seller shall immediately, not later than within 14 days from the date of receipt of the returned product, return all payments received from the Customer, including the costs of delivering the Product, except for additional costs resulting from the delivery method chosen by the Consumer other than the cheapest ordinary delivery method offered by the Seller.
The Consumer is obliged to bear the direct costs of returning the Products.
Returns of Products sent on the cost of the Seller or cash on delivery will not be accepted.
The cost of express realisation is non-refundable.
In the case of Buyers who are not consumers within the meaning of Art. 221 of the Civil Code (Journal of Laws No. 16 item 93, as amended), i.e. people performing legal activities directly related to their business or professional activity, withdrawal from the contract in the above scope is completely excluded – please do your shopping thoughtfully.

§ 6 EXCHANGE

If you wish to exchange the purchased Product for another, first it will be necessary to return it within 14 days from the date of receipt of the Product, with an enclosed return statement which is included in the Exchange Form.
The right to exchange applies only to the Product or Products that are in original condition.
The cost of returning the Product to the Online Shop is borne by the Customer. § 7 COMPLAINTS

In accordance with the Act of June 24, 2014 on consumer rights (Journal of Laws No. 2014, item 827). The Customer has the option of submitting a complaint within 6 years from the date of receipt of the product. In the event of a complaint, the Seller makes a decision within 14 business days and informs the customer on the following procedures.
